COMPETITION AND CONSUMER ACT
For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), www.freddystore.com.au’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

DELIVERY OF PHYSICAL GOODS
www.freddystore.com.au uses Australia Post to deliver physical goods. www.freddystore.com.au is not responsible for goods that are either damaged in transit or not received. Damaged or lost orders should be resolved with Australia Post. Replacement of damaged or lost items is made at the discretion of www.freddystore.com.au 

ORDER CANCELLATION/ PRICING ERROR
All orders are considered final when confirmed at checkout. If you wish to change any part of your order , please email support@freddystore.com.au. Once an order is packed or processed, any change on the order may not be possible. Any change in an order is also not possible during the Christmas season or when purchase was made during an ongoing Sale or promotion. If the order is eligible for a return you may opt to return to us in accordance with the returns policy.

We also reserve the right to cancel any order placed on our website or invalidate any  pricing error on our website, emails, social media or any other channel for the following reasons:

  • Fraud: If we suspect any fraudulent activity or transaction, the order will be cancelled and the incident will be reported to the appropriate authorities.
  • Out of stock: If the product(s) you ordered is out of stock, we will notify you and cancel the order. We will provide a full refund or suggest a suitable replacement if available.
  • Error on pricing or listing: We make every effort to ensure that our prices and product listings are accurate. However, if there is an error in pricing or listing, we reserve the right to cancel/ refund the order ror invalidate pricing
  • Fail verification check: If we are unable to verify your identity or payment information, we reserve the right to cancel the order.
  • Pending payment from previous order: If you have any pending payments from a previous order, we will cancel your current order until the previous payment is cleared.
  • History of dishonesty: If you have a history of dishonesty or fraudulent activity with us, we reserve the right to cancel any future orders.
  • Breach of terms: If you breach any of our terms and conditions, we reserve the right to cancel your order.

If we cancel your order, we will notify you by email and provide a full refund.

 

International Customers
Our international pricing is designed to offer a smooth and transparent shopping experience. It may include applicable duties and taxes, supports reliable express delivery through trusted carriers, and allows us to offer free shipping thresholds in most  countries. As such, international pricing may differ from our local Australian pricing, as it is adjusted for regional shipping and service costs. All prices are displayed in the local currency of the customer’s shipping country and may vary from the Australian RRP/Pricing. Please take note as well that due to this, promotions, sale and bundles offered will also differ compared to what is advertised/ listed in AUD.

FREDDY GIFT CARD
Valid only on freddystore.com.au: Gift cards are issued by and can only be redeemed on freddystore.com.au. They cannot be used on any other websites, subsidiaries, or retail locations.

Non-Transferable & Non-Refundable: Gift cards are non-transferable, non-refundable, and cannot be exchanged for cash

Expiration: Gift cards have a stated expiration date, which cannot be extended under any circumstances. Once expired, any remaining balance will be forfeited. Freddy reserves the right to expire or change expiry at any time without prior notice.

Partial Use: If your purchase is less than the value of your gift card, the remaining balance will remain available for future purchases until the card expires.

Lost or Stolen Cards: We are not responsible for lost, stolen, or damaged gift cards. Store credit is linked to your account and cannot be transferred.

No Cash Redemption: Gift cards cannot be redeemed for cash, except where required by law.

Fraud and Misuse:
Any gift card obtained through fraudulent, unauthorised, or illegal activities, including but not limited to theft, hacking, resale, or use of false information will be immediately invalidated. Freddy reserves the right to:

  • Cancel or freeze any account associated with fraudulent activity.
  • Revoke any associated gift card balances.
  • Pursue legal action and/or report fraudulent activity to the appropriate authorities.
  • Recover funds lost due to fraudulent use, including debiting amounts from associated accounts.

Additional Restrictions: Some Gift cards cannot be used in conjunction with certain promotions, discounts, or special offers unless otherwise stated.

By purchasing or using a gift card/store credit from freddystore.com.au, you agree to these terms and conditions.

 

STORE CREDIT

Store credit is issued by Freddy when:

A return is processed (where applicable under our Returns Policy), or

Our Customer Service team issues credit as a courtesy or resolution.

Use & Redemption

Store credit can only be redeemed on freddystore.com.au, and cannot be used on any other Freddy websites, locations, or partners.

Store credit is non-transferable, non-refundable, and cannot be exchanged for cash.

Store credit is linked to your customer account and can only be used by the original recipient.

Expiration

Store credit has an expiry date, which will apply. Store credit may also be expired or retired if it remained unused or inactive for more than 3 months

Once expired, any remaining balance will be forfeited.

Freddy may update expiry periods or retire inactive/aged store credit balances at its discretion and is not required to provide prior notice.

Partial Use
If your purchase is less than the credit value, the remaining balance will stay on your account until the credit expires.

Fraud & Misuse
Any store credit obtained through fraudulent, unauthorized, or illegal activity will be cancelled immediately. Freddy may take further action including:

Freezing or closing associated accounts

Revoking balances

Recovering losses or reporting activity to authorities

 

Mobile Terms of Service

The Freddy AU mobile message service (the "Service") is operated by Ventures Downunder Pty Ltd (ABN 43 600 201 330 ), t/a “Freddy Australia & New Zealand” and “Freddy Store” (“Freddy AU”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Freddy AU’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Freddy AU through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Freddy AU. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to FreddyAU or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Freddy AU mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
